Terms of Service

Welcome to profits-compass ("profits-compass", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our website, AI consultation tools, digital blueprint reports, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or older in your jurisdiction) to use the Service. By using it, you represent and warrant that you meet this age requirement and that you are not barred from using the Service under any applicable law.

2. Account and security

  • You are responsible for safeguarding the email address and any authentication token you use to access the Service.
  • You agree to provide accurate information during sign-up and to keep it current.
  • You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect any unauthorized access.
  • We are not liable for any loss or damage arising from your failure to secure your account.

3. Description of the Service

profits-compass provides an AI-driven monetization consultation: you describe your skills, available time, and goals; the AI generates a personalized strategy and a digital PDF blueprint. Outputs are produced by a large-language model and are intended for informational and educational purposes only.

4. Subscriptions, billing, and cancellation

  • Paid plans (Monthly, Annual, and One-time unlock) are billed in advance through our PCI-DSS compliant payment processor (Stripe). Prices are shown in U.S. dollars and may change with 30 days' notice for future billing periods.
  • Monthly and Annual subscriptions auto-renew until canceled. You may cancel any time from your profile. Cancellation takes effect at the end of the current billing period; you keep paid access until then.
  • One-time unlocks grant permanent access to a single report download and are non-recurring.

5. Acceptable use

You agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to reverse-engineer, decompile, or otherwise extract the source code or underlying models of the Service.
  • Use automated tooling (bots, scrapers, RPA) to bulk-extract reports, prompts, or other content, except as expressly permitted by our public API.
  • Resell, sublicense, or commercially redistribute any content generated through the Service without written permission.
  • Upload content that is unlawful, infringing, defamatory, obscene, or that infringes the rights of any third party.
  • Interfere with or disrupt the Service, its security features, or any associated infrastructure.

6. Intellectual property

  • Our IP: the Service, including its design, code, AI prompts, knowledge bases, branding, and trade dress, is owned by profits-compass and protected by copyright, trademark, and other laws.
  • Your content: you retain ownership of the inputs you provide. You grant us a worldwide, non-exclusive, royalty-free license to use those inputs solely to operate and improve the Service for you.
  • Generated output: the AI-generated report is licensed to you for personal, non-commercial use. Mass redistribution or resale is prohibited.

7. No professional advice

The Service provides informational and educational content only. It is not legal, financial, tax, medical, or investment advice, and it is not a substitute for consultation with a qualified professional in your jurisdiction. You are solely responsible for evaluating the accuracy and applicability of any output before acting on it.

8. Third-party services

The Service depends on third-party providers including Stripe (payments), OpenAI (AI generation), and Resend (transactional email). We are not responsible for the availability, accuracy, or content of those providers' services. Your use of their services is governed by their respective terms.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or pose a risk to other users or to us. You may stop using the Service at any time and request account deletion from your profile or by emailing [email protected].

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PROFITS-COMPASS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS (US$100).

12. Indemnification

You agree to defend, indemnify, and hold harmless profits-compass and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Dispute resolution and governing law

  • Informal resolution first: before filing a claim, email us at [email protected] and we'll try to resolve the dispute within 30 days.
  • Governing law: these Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.
  • Forum: any unresolved dispute will be handled exclusively in the state or federal courts located in Delaware, except where applicable consumer law provides otherwise (e.g. EU consumers may also bring claims in their home country).
  • Class-action waiver: to the maximum extent permitted by law, you waive any right to participate in a class-action or class-wide arbitration.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we'll bump the "Last Updated" date above and, for material changes, notify signed-in users by email at least 14 days before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
